Terms of Service

Who we are and what these terms cover

These terms apply to your use of Twinpage (the "Service"), which is operated by Ziad Antar, trading as Twinpage, United Arab Emirates ("we", "us"). By creating an account or installing the Twinpage snippet you agree to them. If you use the Service for an organisation, you confirm you are allowed to accept these terms for it.

The Service

Twinpage lets you run A/B tests on a website you control by adding one script tag, and shows you the results. This is a launch version: features and limits can change.

Your account

You need a valid email address, and either a password or a Google or Apple account to sign in. Keep your password secure; you are responsible for what happens under your account. Tell us at hello@twinpage.app if you think someone else has accessed it.

Plans, limits and billing

The Free plan costs $0 and includes up to 10,000 tested sessions a month, 1 project and 1 running experiment. The Starter plan costs $49 a month and includes up to 50,000 tested sessions a month, 3 projects and 5 running experiments. The Growth plan costs $99 a month and includes up to 200,000 tested sessions a month, 10 projects and 15 running experiments. Each plan's other limits and features are listed on the Pricing page.

A tested session is a browser session in which a visitor saw one of your experiments. Sessions are counted per calendar month (UTC). When your account reaches 125% of its monthly sessions, we pause your experiments until the next month or until you upgrade. While they are paused your visitors see your original pages.

A paid plan (Starter and Growth) is a monthly subscription billed through Paddle. It renews automatically until you cancel. You can cancel or move to a lower plan at any time from Manage billing in the dashboard. A cancelled plan continues until the end of the period you have paid for, and your account moves to Free after that. If you have more projects or running experiments than your new plan allows when your plan changes, we disable your projects and pause your running experiments until you choose which projects to keep. Nothing is deleted.

Prices are shown without tax. Paddle.com, our authorised reseller and seller of record, adds any sales tax or VAT at checkout and remits it. Refunds are described in the Refund Policy. If we change our prices, we will email you at least 30 days before the new price applies. If you don't agree, you can cancel before then and you won't be charged the new price.

Your responsibilities

Use Twinpage only on websites you own or are allowed to change. Follow the law that applies to you and your visitors, including rules on privacy notices and consent; the Snippet privacy and consent page explains what the snippet stores. You are responsible for telling your visitors what you need to tell them.

Do not overload or abuse our public endpoints, send fake events, try to reach another customer's data, or use Twinpage to mislead people or break the law. Do not put personal data in the names of experiments, goals or events.

Acceptable use

Do not use Twinpage on sites aimed at children, to process special categories of personal data, to show visitors deceptive or unlawful content, or to collect data you are not allowed to collect.

Custom JavaScript

If you use custom JavaScript, you are responsible for the code you add, for what it does on your visitors' devices, and for having the right and any consent needed to run it on the sites where your tests run. Don't use it to collect passwords, payment details or other sensitive data, to track people across sites, or to deliver malware. We may turn custom JavaScript off for any project, or for the whole Service, at any time and without notice, to protect visitors, you or the Service; your visitors then see your other edits or your original page.

Your data

You keep all rights in your website and your content. We process the account and experiment data you give us only to run the Service, as described in our Privacy Policy.

Data processing

When you install the snippet, you decide which visitors' data it handles and why: for that data you are the controller and we process it on your behalf. Our Data Processing Agreement forms part of these terms and applies whenever we process personal data for you under the GDPR, the UK GDPR or similar laws. It includes the standard contractual clauses for transfers out of the EU and the UK.

Confidentiality

We keep your account and experiment data confidential and use it only to provide the Service, except where the law requires otherwise.

Our rights

We own the Service and the snippet. We give you a non-exclusive, non-transferable right to use them while your account is open, under these terms. If you send us feedback, we may use it freely.

Availability and changes

We work to keep Twinpage running, but we do not promise uninterrupted service or any particular level of availability during the launch version. We may change or stop features, and will give reasonable notice where we can.

Suspension and ending

You can stop using Twinpage at any time and delete your account on the Account page (or ask us, if your account has several members). We may suspend or end your access if you break these terms, abuse the Service, do not pay, or the law requires it. Where it is reasonable, we will tell you first. If we end your access, we will delete your account data within 30 days unless the law requires us to keep it; ask us first if you want a copy.

Results and liability

Test results are statistical estimates. Decisions you make from them are yours. The Service is provided "as is". To the extent the law allows, we are not liable for indirect losses or lost profits or revenue, and our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim and USD 100. Nothing in these terms limits liability that cannot be limited by law.

Your responsibility to us

You will cover our reasonable costs from a third-party claim caused by your content, your custom JavaScript, or your use of the Service in breach of these terms or the law.

Changes to these terms

We may update these terms. If a change is material, we will tell you by email or in the dashboard at least 30 days before it applies. If you don't agree, you can cancel before it applies; your plan then runs to the end of the period you have paid for, and within 14 days of a charge the Refund Policy applies. If you keep using Twinpage after it applies, the updated terms apply to you.

Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah. The courts of Ras Al Khaimah have exclusive jurisdiction over any dispute about them.

The Service is for business use. By accepting these terms you confirm you are acting for a business, trade or profession.

General

We may transfer these terms to a successor of our business; you may not without our consent. If a part of these terms is unenforceable, the rest stays in force. These terms, the Privacy Policy, the Refund Policy and the Data Processing Agreement are the whole agreement between us. We are not liable for delays caused by events outside our reasonable control. We send notices to your account email; send yours to hello@twinpage.app.
